  • Broke written safety rules that were clearly posted and explained to you
  • Failed to do your job properly after two written warnings
  • Leaked confidential company information for personal gain or that caused damage

  • Assaulted your employer, a manager, or a colleague
  • Were absent without a valid reason for more than 20 non-consecutive days, or more than 7 days in a row, in one year
  • Misused your position for personal gain

Does My Employer Have to Investigate Before Firing Me?

No, these are two separate issues.

  • Arbitrary, or unlawful, dismissal concerns the true reason for the termination, particularly whether it was carried out in retaliation for something the employee is legally protected for.

Can I Be Fired From My Job for Filing a Complaint Against My Employer?

No, not lawfully. Under Article 47, if an employee is dismissed because they filed a genuine complaint with MOHRE or a lawsuit against their employer, and that complaint is proven valid, the dismissal is considered unlawful.

Where a court agrees, the employer may be required to pay compensation, capped at three months' wages based on the employee's last salary. This is separate from, and does not replace, notice pay, gratuity, or other amounts owed.

Can I Be Fired From My Job While Pregnant or on Maternity Leave?

No. Article 30(8) specifically prohibits terminating an employee due to pregnancy, maternity leave, or related absence. A dismissal connected to this may be treated as unlawful, and may entitle the employee to compensation in addition to standard end-of-service dues.
