Quick Summary
If you are owed money in the UAE, the route you take depends on your evidence and on whether the debtor disputes the debt. A clear, written, undisputed debt may suit a payment order. A disputed debt usually needs an ordinary civil claim. A bounced cheque can often be enforced through a separate route. Once you hold a judgment or enforceable order, the execution court can enforce it against the debtor’s assets.
At Alaa ElHoushy Legal Consultancy, we provide legal consultation to creditors seeking to recover money and to debtors responding to claims across the UAE, including unpaid loans, invoices, bounced cheques and other outstanding debts.
| Recovery Route | When It May Apply | What It Does |
|---|---|---|
| Payment Order | A clear, documented, undisputed debt | Provides a route to seek a court order for payment |
| Civil Litigation | The debt is disputed, or the evidence is not enough for a payment order | Allows the dispute to be decided through court proceedings |
| Cheque Enforcement | A dishonoured cheque that meets the legal requirements | May allow the cheque to be taken to execution without a full trial |
| Execution | A judgment or enforceable order has been obtained | Enforces the debt against available assets or income |
| Settlement | Both sides are prepared to settle | May resolve the matter without prolonged litigation |
The right route depends on the type of debt, the available evidence, and whether the debtor disputes the claim.
How to Recover Unpaid Debt in the UAE
Most recovery cases follow the same path. The details change depending on the debt.
- Confirm the debt. Gather the contract, invoices, transfer records and messages. Work out the exact amount owed and the date it fell due.
- Send a formal written demand. State the amount, the basis of the claim and a deadline for payment. For a payment order, a prior written demand is generally required.
- Choose the route. Where the debt is clear and supported by written evidence, a payment order may be faster than ordinary litigation. Payment orders are governed by the UAE Civil Procedure Code, including Federal Decree-Law No. 42 of 2022. If the debt is disputed, the matter may need to proceed as a civil claim.
- Check pre-filing requirements. Some disputes in Dubai must go through conciliation first. See “Do I Need to Try Mediation First?” below.
- File with the competent court. Documents generally need to be in Arabic, or accompanied by a legal translation.
- Serve the debtor and wait for the response. If the debtor objects to a payment order, the matter may continue as an ordinary claim.
- Enforce. If the debtor does not pay after a judgment or order, apply to the execution court.
Types of Debt Recovery Matters We Advise On
– Debt Claims
We advise on money owed under loan agreements, invoices, contracts, written acknowledgments and other documented obligations. The first step is usually reviewing the available evidence to decide how the debt can be pursued.
– Payment Orders
Where the debt meets the legal requirements and is supported by documents, a payment order may be a faster route than ordinary litigation. See the section on documents below.
– Judgment Enforcement
A judgment does not always end the recovery process. We advise on the execution process and the measures that may be available. See “What If the Debtor Isn’t Paying After a Judgment?” below.
– Asset Tracing
If a debtor says they cannot pay, finding available assets can become an important part of recovery. We advise on asset tracing and the legal steps that may follow.
– Settlement and Negotiation
Not every debt dispute needs to continue through lengthy court proceedings. We advise on settlement terms and help clients understand the legal implications before agreeing to them.
– Responding to a Debt Claim
Debt recovery is not only for creditors. If you have received a claim for a debt you dispute or believe is incorrect, you may have grounds to challenge it. We advise debtors on documented defences, disputed amounts, procedural issues, execution measures and settlement options.

What Documents Are Needed for a Payment Order in the UAE?
A payment order is generally for a debt that is a fixed sum, due for payment and supported by written evidence. The documents required depend on the debt. Useful evidence includes:
- Signed loan agreements or IOUs
- Written acknowledgment of the debt
- Invoices and supporting contracts, delivery records or purchase orders
- Bank transfer and payment records, including partial payments
- Emails, WhatsApp messages or other communications referring to the debt
- Dishonoured cheques, where applicable
- Relevant identification and company documents
- Any previous demand or settlement correspondence
The documents should clearly show that the debt exists and what the amount is. Keep them together. If they do not meet the requirements for a payment order, another route may be needed, and the court can treat the claim as an ordinary one.
What Happens If the Debt Is Disputed?
If the debtor genuinely disputes the debt, the matter may need to proceed through ordinary civil litigation instead of a payment order. The process generally involves:
- Assessment – Reviewing the agreement, evidence, payments and the basis of the dispute.
- Demand and claim – A formal demand may be sent before legal proceedings are started, where appropriate.
- Court proceedings – The parties present their arguments and supporting evidence before the court.
- Judgment – The court decides the claim based on the evidence and applicable law.
- Execution – If a judgment is issued and the debtor does not pay, enforcement procedures may follow.
The time required varies considerably depending on the complexity of the claim, the evidence, whether it is contested and the procedural steps involved.
Bounced Cheques and Debt Recovery
Since January 2022, most bounced cheques caused by insufficient funds are treated as civil debts. In many cases, a cheque that meets the legal requirements can be taken to the execution judge as an enforcement document, without first obtaining a full judgment.
Whether this route applies depends on the cheque and the circumstances. See our guide to a cheque bounce case in the UAE for more detail.
Do I Need to Try Mediation First?
Not every debt claim follows the same pre-litigation procedure.
In Dubai, certain disputes must go through the Centre for Amicable Settlement of Disputes (CASD) before a claim can proceed to court. The Centre is regulated by Dubai Law No. 18 of 2021 (as amended). Whether it applies depends on the type and value of the claim, so confirm this before you file.
How Long Do I Have to File a Debt Recovery Claim?
The limitation period depends on the type and legal basis of the debt.
Different rules may apply to contractual debts, commercial claims, cheques and other obligations. Changes to UAE civil law may also affect how limitation periods are calculated in particular circumstances. See our guide to the UAE New Civil Transactions Law.
If you believe a limitation period is approaching, review the dates and documents rather than assume the same period applies to every type of debt.
What If the Debtor Isn’t Paying After a Judgment?
A judgment does not always mean the money will be paid immediately.
If the debtor does not comply, execution procedures may be required. Depending on the circumstances and the rules that apply, enforcement can include attachment of bank accounts, salary (within legal limits), property and vehicles, and in some cases a travel ban where the legal conditions are met.
This is why it is important to consider recoverability and available assets, not only whether you can obtain a judgment.

What If the Debtor Says They Have No Money?
A claim that a debtor cannot pay does not always end the matter. Asset tracing can help identify assets that can be enforced against, and a debtor’s position can change over time.
If the debtor is a company facing insolvency or liquidation, different rules apply and claims are usually handled through that process. Early advice matters in these cases. See our page on bankruptcy matters.
If the non-payment involves fraud or a breach of trust, see our white-collar crime page. For unpaid rent, see our rental disputes page.
Can a Debtor Challenge or Defend Against a Debt Claim?
Yes. A debtor may be able to challenge a claim where there are valid legal or factual grounds. For example, the debtor may dispute:
- The existence of the debt
- The amount claimed
- Whether payment has already been made
- The validity of the underlying agreement
- The claimant’s evidence
- A procedural step taken during enforcement
The available response depends on the facts and supporting documents.
How Much Does Debt Recovery Cost and How Long Does It Take?
Costs and timing depend on the case. The main factors are:
- Court fees, which depend on the claim and the court’s current schedule
- Translation of documents into Arabic, where needed
- Professional fees for advice and preparation
- Whether the debtor disputes the claim. A contested case takes longer than an uncontested one
- Service of documents on the debtor
- Enforcement. Recovering the money can take longer than obtaining the order, especially where assets must be traced
Check the current court fee schedule before you file. We can explain what to expect for your type of debt after reviewing your documents.
Why It’s Important to Get Legal Advice Before Filing?
Choosing the wrong recovery route can cost time and money. A payment order may not be suitable if your documents do not meet the legal requirements. A straightforward documented debt may be delayed if it is taken through a more complicated process.
Early legal review can help you:
- Identify the appropriate recovery route
- Check whether your evidence supports the claim
- Understand procedural requirements and deadlines
- Spot problems before you file
- Assess settlement options
- Understand what may happen if the debtor disputes the claim

Frequently Asked Questions
What is the difference between debt recovery and debt collection?
Debt collection generally focuses on obtaining payment, while debt recovery can include formal legal procedures such as payment orders, civil claims, settlement, and judgment enforcement.
Can debt recovery in the UAE be resolved without going to court?
Yes, often through negotiation, a demand notice, or a settlement. Some disputes must also go through CASD mediation first. Court is usually a last resort.
What is the difference between domestic debt collection and international debt recovery?
Domestic recovery involves a debtor based in the UAE, using standard local procedures. International recovery involves a debtor abroad, adding cross-border enforcement and jurisdiction issues, so it usually takes longer.
What if the debtor claims to have no money?
It’s not the end of the road. Asset tracing can uncover undisclosed assets, and a court can still record the debt as owed for later recovery if the debtor’s situation improves.
